This website is owned and operated by Myora Travels (Private) Limited, a company duly incorporated under the company laws of Sri Lanka, having its registered office at No 51/42A, Wimana road, Homagama, Sri Lanka (hereinafter referred to as “Myora”).

By accessing and using this website, you agree to be bound by the terms and conditions of use set out below. The attached terms of online reservations (tour bookings, transport, accommodations, transfers, and excursions) will apply when you make reservations online and form part of this agreement. Our data protection principles are also annexed for your reference.

TERMS AND CONDITIONS OF USE

ACCEPTABLE USE

You (customer/agent) may use this website in accordance with these terms and conditions for lawful and proper purposes, complying with all applicable laws, regulations, and codes of practice in Sri Lanka or other jurisdictions from which you access the website.

In particular, you agree not to post, transmit, or disseminate any information via this website which is or may be harmful, obscene, or otherwise illegal.

You also agree not to:

  • Use this website in a manner which causes or may cause an infringement of the rights of another.
  • Use any software, routine, procedure, or device to interfere or attempt to interfere with the operation or functionality of this website, including but not limited to making available corrupt data, viruses, or interfering with its availability to others.
  • Deface, alter, or interfere with the look and feel of this website or underlying software code.
  • Take any action that imposes an unreasonable or disproportionately large load on the website or related infrastructure.

MODIFICATION OF TERMS

Myora may make improvements and/or changes in the products, services, and prices described in this website at any time without prior notice. Changes are periodically made to the website. Myora may amend these terms by posting the amended terms on this website. Continued use of this website following such changes shall constitute your acceptance of such changes.

AGE AND RESPONSIBILITY

You represent that you are of sufficient legal age to use this website; additionally, you possess the legal right and ability to enter into this agreement and use this site in accordance with all applicable terms and conditions and create binding legal obligations for any liability you may incur as a result of the use of this website under your name or account, including without limitation all use of your account by others, including minors living with you.

PAYMENT POLICY

All services provided by Myora are subject to the following terms and conditions. “Services” refers to any one or more of the following: (a) Transport (b) Accommodation (c) Other tourist services.

Your Booking

Booking details must be completed personally by the traveler or by one person on behalf of a group who is deemed authorized by individual members (the “Client”) of the Group to contract on their behalf. Myora will confirm the arrangements requested by the Client through web bookings as soon as reasonably possible upon receipt of the booking details. Please note that for legal purposes, the contract comes into existence when a confirmation invoice has been issued by Myora for services rendered by Myora or on behalf of the relevant suppliers. Despite its best efforts, as services are obtained from third-party suppliers, it may not be possible to confirm certain arrangements at once (e.g., when a hotel is only available on request). Where so specified, the legal contract for the services concerned will be formed once Myora has specifically confirmed those services have been booked, even if a previous interim confirmation has been issued.

The Client is responsible for checking the details of the confirmation invoice and should give immediate notice of any corrections thereto.

Your Contract

This contract and all services provided by Myora are exclusively governed by Sri Lankan law. The Client acknowledges that although the contract is with Myora, unless otherwise specified, all services are provided by third-party service providers (e.g., hotels, transport operators, tour guides) and that whilst every effort has been made by Myora to ensure that such services are safe, it is unable to accept responsibility for third-party services out of its control. Myora contracts as named agent only.

The Client specifically acknowledges that all arrangements made by Myora for hotel accommodation, sightseeing tours and services, entertainment, transportation by air, railroad, motor bus, automobile, or boat, Myora acts only in the capacity of an agent for the domestic airlines, hotels, and other suppliers for the Services described in the tour arrangements. In particular, the Client acknowledges that because Myora maintains no management control over the personnel, equipment, or operations of these service suppliers, Myora cannot assume responsibility for and be held liable for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason of (1) any wrongful, negligent, or unauthorized acts or omissions on the part of any of the suppliers, (2) any wrongful, negligent, or unauthorized acts or omissions on the part of any employee of any of these suppliers, (3) any defect in or failure of any vehicle, equipment, or instrument owned, operated, or otherwise used by any of these suppliers, or (4) any wrongful or negligent acts or omissions on the part of any other party not under the supervision and control, direct or otherwise, of Myora.

The relevant suppliers’ terms and conditions will be available on the relevant voucher or can be obtained from the supplier.

Payment

Except where expressly specified by Myora in writing, payment in full for all Services will be processed upon confirmation of arrangements, or make 50% of the full payment and settle the balance 50% before 21 days of arrival. In any event, Myora is under no obligation to provide any Services until payment in full has been received as specified in the payment confirmation page or as instructed in the confirmation email prior to commencement of the tour. Myora reserves the right to cancel the tour and/or apply cancellation charges if payment is not made within the said period.

The Cost of the Tour

The cost of Services may increase after confirmation if there have been increases in the costs at supplier level. However, every effort shall be made by Myora to limit price increases only to increases in transportation costs (e.g., fuel, scheduled airfares and any other domestic airline surcharge which are part of the contract between domestic airlines and the tour operator) or in dues, taxes, or fees chargeable for services such as landing taxes or embarkation/disembarkation fees at ports or airports, or because of adverse exchange rate variations after confirmation of the booking.

All increases in prices are payable by the dates stated above or by the dates specified on the notice of increase, whichever is later.

Amendments to the Itinerary by the Passenger

After confirmation, if the Client wishes to change the dates or nature of Services, an application to do so may be made on the Myora website, and Myora shall endeavor to accommodate such changes at the least cost to the Client. The Client shall be responsible for all extra costs of such change. No credits or refunds for unused services shall be given if the Client fails to avail themselves of the confirmed tour arrangements.

Complaints

If the Client has a complaint regarding services, the relevant supplier (e.g., hotelier or transport provider) should be informed immediately or as soon as possible (in any event no later than 24 hours) of the occurrence of the event giving rise to the complaint. If the supplier cannot resolve the complaint, Myora must be informed in writing within forty-eight (48) hours with the original booking reference and all relevant information.

The Client acknowledges that problems can only be resolved if Myora and service providers are made aware immediately as and when they occur. Myora regrets that it cannot accept liability in relation to any complaint or claim which is not notified in accordance with this clause.

Any disputes arising between Myora and the Client in respect of any complaints remaining unresolved for more than thirty (30) days shall be referred to arbitration by a single arbitrator in accordance with the ICC Rules for Arbitration. The language of the arbitration shall be English, and the place of arbitration shall be Colombo, Sri Lanka.

General

The Client is responsible for consequences of illness and/or accidents and must pay possible expenses to doctors, hospitals, ambulances, and special transports. It is their responsibility to have adequate medical insurance for such eventualities. Myora also recommends that Clients obtain travel insurance with full cancellation cover.

Clients shall be responsible for ensuring that all visa, immigration, and health requirements are fulfilled.

Clients hereby expressly acknowledge that all facilities, services made available and/or recommended by Myora and utilized by the Client shall be at the Client’s risk, and that Myora shall not be responsible for any damage or injury to the Client in this regard unless caused by the negligence of Myora.

The Clients take responsibility for their own behavior and will reimburse Myora or its suppliers any damage caused by negligent or reckless behavior by the Client or due to circumstances within the Client’s control.

Methods of Payment

Payments for deposits and final amounts for Travel Arrangements can be made through:

  • Bank Transfer: Any charges arising outside Sri Lanka should be borne by the remitter.
  • Credit Card (Visa and MasterCard): A secure internet payment gateway facility is available. A handling fee of [Insert Your Fee, e.g., 3.1%] may be charged additionally on top of the agreed invoice value. Both credit and debit cards can be used.

Payments are processed entirely on secure payment sites. Your card details are neither received nor stored by Myora in any form. Payments can be made in US$.

Price Policy

We offer customized packages of land and/or air services to our clients, utilizing various suppliers. The pricing of Your Travel Arrangements is subject to the possibility of changes and surcharges beyond our control. These changes may occur due to governmental actions, fluctuations in currency exchange rates, increases in suppliers’ prices, or other factors. If the price of Your Travel Arrangements is affected by matters beyond our control, you are required to either pay the additional amount when requested or cancel Your Travel Arrangements following the conditions outlined in these Booking Terms.

All prices are quoted in United States dollars.

AMENDMENTS AND CANCELLATIONS

Amendments by You We reserve the right to charge a USD 100 administrative fee per change in the event that you wish to transfer to another tour, modify a confirmed booking, or alter your Travel Arrangements in any way after confirmation. This fee is in addition to any cancellation, amendment, or other charges imposed by third-party operators, suppliers, hotels, or airlines. The fee applies regardless of whether we are able to successfully confirm the requested amendment. We will make every effort to accommodate reasonable changes, subject to availability and any additional costs, which must be paid by you in full prior to the change being processed.

Changes by Myora While we will make every effort to provide all Travel Arrangements as confirmed, we reserve the right to make reasonable changes to your itinerary, accommodations, transport, or other services without prior notice if deemed necessary or advisable due to circumstances beyond our control (e.g., weather, supplier issues, safety concerns, or operational requirements).

Cancellations by You Any cancellation must be notified to us in writing (via email to [insert your email, e.g., bookings@myoratravels.com]) and will take effect from the date we receive your written notice. The following cancellation charges will apply based on the number of days before your Travel Arrangements commence:

  • More than 60 days before start date: Forfeit of deposit only
  • 31–60 days before start date: Forfeit of deposit
  • 21–30 days before start date: 50% of total ground arrangement cost
  • 14–20 days before start date: 75% of total ground arrangement cost
  • 14 days or fewer before start date: 100% of total ground arrangement cost (no refund)

Airline and Other Supplier Cancellations Cancellations of commercial flights or airfares will be subject to the airline’s own tariff regulations and cancellation policies, which may result in full forfeiture of the airfare. You are responsible for any such charges.

Our cancellation policy overrides any conflicting cancellation provisions set out by individual hotels, operators, or suppliers used in your booking. No refunds will be given for cancellations after the commencement of your Travel Arrangements or for any unused portions of the tour (e.g., due to no-show, early departure, or personal reasons).

Special Conditions for Boutique Properties and Special Arrangements Certain boutique hotels, luxury accommodations, or exclusive experiences may have stricter cancellation policies. Where applicable, a 100% non-refundable cancellation fee may be charged in line with the supplier’s terms. These will be clearly stated in your confirmation invoice or booking voucher.

Recommendation We strongly recommend purchasing comprehensive travel insurance that includes coverage for trip cancellation, interruption, and any medical or emergency expenses.
